Sen Dan Sullivan (R-AK) is hammering Biden tonight for some lawless policies Biden will announce tomorrow, 20 April.
Sullivan’s focus is wrong. His demands need to be pointed at the governor of AK.
No - zero, zilch, nada - authority exists in the Constitution for federal ownership of land OTHER THAN as required to execute the enumerated powers. None.
The Governor of each state has executive authority over their state. Each governor has executive authority exceeding the president except as delegated in the enumerated powers. This is what the Tenth Amendment is about.
Do the Feds have constitutional authority to own, grab, close, or dictate land policy to any state?
No. Period. End of memo.
Doing so is usurpation of Tenth Amendment powers reserved by the several states. It is a violation of the Bill of Rights, the Constitution and Biden’s oath of office, making him ineligible even to hold that office; this is why the oath is required before the President-Elect becomes the president.
The Governor just needs to say “No” to the Feds. The Governor has that authority.
Governors have got to step-up and reclaim their place in our Union.
Tell Biden “No.” Arrest and throw out any federal employee engaged in Supra-enumerated powers activities. Take back your authority.
The Feds will not stop leviathan from harming all of us.
The governors can and must.
Which brings into question the unelected, unaccountable Administrative State’s rules and regulations that can destroy a state’s natural resource based economy, such as the Pacific Northwest’s once thriving timber industry — or energy production resources fueled by low cost, reliable fossil fuel. With what authority can Biden order states to sell EVs despite a lack of reliable electric energy resources and EV charging stations? Do Biden’s federal edicts, rules and regulations override each state’s 10th Amendment protections?
